1. Scope and agreement

These Terms and Conditions apply to use of 3dpowdercoating.com.au and, together with an accepted quotation, job sheet, written variation or other agreed document, to services supplied by 3D Powder Coating Pty Ltd (ABN 43 612 121 365), referred to as “3D Powder Coating”, “we”, “us” or “our”.

A quotation or job-specific written agreement prevails to the extent of any inconsistency about that job. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified.

2. Quotations, scope and variations

Quotations are based on the information, photographs, dimensions, quantities, specifications and apparent condition available when the quotation is prepared. A quotation is open for the period stated in it. If no period is stated, please confirm current price and availability before acceptance.

Work outside the agreed scope may be required where stripping, blasting, cleaning or inspection reveals corrosion, damage, contamination, incompatible coatings, poor previous repairs or other conditions that were not reasonably visible beforehand.

Before carrying out material additional work or charging a material additional amount, we will explain the issue and seek your approval. If urgent work is reasonably necessary to prevent immediate damage or address a safety risk and we cannot contact you after reasonable attempts, we may take reasonable protective steps and will explain them as soon as practicable.

3. Customer-supplied items and information

You confirm that you own the items supplied or have authority to instruct us to work on them. You are responsible for giving accurate information about the substrate, previous coatings or treatments, intended use and environment, and any critical surfaces, threads, seals, markings, dimensions, tolerances, heat-sensitive parts or masking requirements.

Unless otherwise agreed, items should be dismantled and supplied free of oil, fuel, hazardous residue and loose attachments. Tell us before delivery if an item may contain hazardous material, pressure, trapped liquid, sealed cavities or components that may be affected by blasting or curing temperatures. We may pause or decline unsafe or unsuitable work.

4. Preparation, colour and finish

We will perform services with due care and skill. Preparation can expose pre-existing corrosion, cracks, porosity, weld defects, filler, thin metal, distortion or previous repairs. These conditions can affect the appearance, adhesion or durability of the final coating even when reasonable care is used.

Colour swatches, photographs and screens are guides. Reasonable variations may occur because of powder batch, gloss level, texture, film thickness, curing, lighting, substrate and the shape or condition of the item. Where matching existing work is important, tell us before acceptance so an appropriate sample or specification can be discussed.

Masking and plug locations must be agreed before work begins. Powder coating adds film thickness and can affect close tolerances, threads and mating faces if they are not identified for protection.

5. Timing, payment, delivery and collection

Estimated completion dates are given in good faith but can be affected by item condition, approved variations, powder availability, curing or rework requirements and events outside reasonable control. We will communicate material delays. Where the Australian Consumer Law requires supply within a reasonable time, that requirement continues to apply.

Prices, deposits, payment stages and GST treatment are as stated in the quotation or invoice. A deposit is applied to the job price. If you cancel after acceptance, we may retain or charge only amounts reasonably reflecting work performed, materials ordered and loss or costs actually incurred, subject to applicable law.

Unless otherwise agreed, the customer is responsible for collection and transport after notification that work is complete. We will give reasonable notice before applying any reasonable storage charge to items left uncollected. Items will not be sold or disposed of except in accordance with applicable law and after any notice required by law.

6. Inspection, concerns and remedies

Please inspect completed work as soon as reasonably practicable and tell us promptly if you believe the agreed service has not been supplied. Photographs and a description of the issue help us assess it. We may reasonably ask for an opportunity to inspect the item and, where appropriate, provide a remedy.

A request for prompt notice helps prevent further damage and investigate the cause, but it does not remove or reduce any right or remedy available under the Australian Consumer Law or other applicable law.

7. Australian Consumer Law

Where the Australian Consumer Law applies, services come with guarantees including that they will be provided with due care and skill, be reasonably fit for a disclosed purpose or achieve a disclosed result where the customer relies on our skill or judgment, and be supplied within a reasonable time where no time is fixed. Remedies depend on the circumstances and applicable law.

8. Website information and acceptable use

Website material is general information and may change. Project suitability, price, timing and finish must be confirmed for the particular item. Images show examples and do not guarantee an identical result.

You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with operation, scrape it unreasonably or use content in a way that infringes intellectual property or other rights. Third-party websites and embedded services are governed by their own terms and privacy practices.

9. Privacy, general terms and contact

Personal information is handled as described in our Privacy Policy. If part of these terms is unenforceable, it is to be read down or severed to the minimum extent necessary and the remaining terms continue. A failure to enforce a term immediately is not a waiver. These terms and each job are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.
